Is your family in Vietnam handling an estate division, and you want to waive your share to pass it to them? You can do it from the U.S. without going anywhere. VietVisas takes care of it for you, from just $170.

What is an inheritance waiver?

It's a document in which you voluntarily decline the estate share you're entitled to by law or by will. It lets the remaining heirs in Vietnam complete the division and transfer title to property or assets.

One thing to keep in mind: a waiver has to be made before the estate is divided. If your family has already set a date for the procedure in Vietnam, start early.

When do you need it?

  • Your family in Vietnam is handling the inheritance of property, accounts, or assets.
  • You want to pass your share to parents or siblings back home.
  • You need valid documents so notarization and title transfer in Vietnam go smoothly.

Four steps

  1. Get the template. Ask the notary office in Vietnam where your family is handling the inheritance for their inheritance-waiver template.
  2. Print and sign. Print it and sign, signing one extra copy for the consulate to keep. Then photograph the other documents needed (passport, Vietnamese ID, and so on) and send them to VietVisas by message, phone, or email — see our document photo guide if your photos keep coming out blurry.
  3. Send it on. Send the signed document to the consulate using the FedEx label VietVisas provides — the shipping is arranged for you.
  4. Receive it at home. The consulate processes the file, and the completed paperwork is delivered to your address within about 3 business days.

Why the template should come from the notary office in Vietnam

Each notary office in Vietnam has its own approved template. Use the form of the office your family is working with and your document fits from the start. Use something drafted yourself, or found online, and you risk signing and sending it again — each round costing another week, because the paperwork travels between two countries.

The simplest approach: ask your relatives which notary office they're using, get that office's template, and send it to us to look over before you sign.

What the waiver needs to say

  • Who is waiving — full name, date of birth and ID number, exactly as they appear on your documents.
  • Whose estate it is — the deceased's full name, and your relationship to them.
  • Which assets — the property, account or specific assets, as precisely as possible.
  • Your decision — that you voluntarily decline your share.

Names that differ between your U.S. and Vietnamese documents — diacritics, or a different surname after marriage or naturalization — are very common. Mention it at the start so it's handled from the outset.

Vietnamese translation — when you need it

A document on the notary office's own template is usually already in Vietnamese, so most files need no translation at all.

If your file includes English documents that need a Vietnamese version, VietVisas can prepare it — an optional service, charged separately. See certified translation.

Cost & why choose VietVisas

The service fee is $170 per document; additional copies are discounted — contact us for details. Translation, if you need it, is charged separately. This service often goes with a power of attorney when you also need a relative to act for you on other matters.

Frequently asked questions

I'm in the U.S. — how do I waive my inheritance in Vietnam?
You sign the inheritance-waiver document in the U.S. and send it on as VietVisas directs. The completed document comes back to your home, ready for your family to use when the estate is divided in Vietnam.
Do I have to go to the consulate?
No. You print the document, sign it, and send it with the FedEx label VietVisas provides. The completed file comes back to your home address.
Where do I get the template?
Ask the notary office in Vietnam where your family is handling the inheritance. Using the form that office accepts is the surest way to avoid signing and sending it again.
Why would I waive an inheritance?
Many people abroad want to pass their share to relatives back home, or to make property division and title transfer in Vietnam smoother. A valid waiver speeds up the process.
What if several co-heirs all want to waive?
Each person usually signs a separate document. VietVisas can process multiple family members' files at once.
Does it need a Vietnamese translation?
A document on the notary office's own template is usually already in Vietnamese, so no translation is needed. If your file includes English documents that must be translated, VietVisas handles that as an optional add-on for a separate fee.
